TERMS AND CONDITIONS*
Smart HELPERS Center (SHC) is a registered Private Employment AGENCY (PEA) as per South Africa’s Employment Services Act, 2014 (Section 13 and Clause 2 of schedule 2) and Skills Development Act, 1998 (Section 24 (1) – (5)). SHC, subsequently referred to as The AGENCY, provides placement of HELPERS to EMPLOYERS.

- The AGENCY: The placement company through which the EMPLOYER recruits a HELPER for employment
- EMPLOYER : A person or an organization employing a HELPER to render a service
- HELPER: An independent service provider introduced to EMPLOYER S for an employment opportunity
- Salary: This means any remuneration, fees, bonuses, commission, allowances, or any other financial benefit payable to, or received by a HELPER for services to an EMPLOYER.

TERMS AND CONDITIONS OF SMART HELPERS CENTER FOR HELPER HIRING

1. I hereby agree to use the services of Smart Helpers Center for my own use and not on behalf of a third party.
2. I agree to the terms and conditions as they currently are and accept that these are subject to change and Smart Helpers Center is not under any obligation to give prior notice of these changes.
3. I understand by using the services of Smart Helpers Center, I am bound by all the Terms and Conditions of Smart Helpers Center.
4. Responsibility for the decisions I make regarding services offered via the software or service (with all its implications) rests solely with me. Smart Helpers Center shall not be held liable to any Client in any circumstances whatsoever for any loss, injury, theft or death caused, damage of any nature whatsoever or howsoever sustained, whether as a result of any negligence, non-compliance and/or breach of this agreement or by the Helper recruited through Smart Helpers Center and the Client hereby indemnifies Smart Helpers Center and holds it harmless against any such claim by any other person..
5. Smart Helpers Center will not be a party to disputes, negotiations of disputes between you and the helper you have hired.
6. Smart Helpers Center will do their utmost best to check the legal status of each Helper placed but will not be held responsible if the Helper misled both Smart Helpers Center and the Client.
7. I agree to adhere to all Labour Law Regulations with my Helper, including an employment contract, payment of UIF, overtime, salary and salary increases.
8. I agree to adhere to Section 10 of the Constitution of 1996 of the Republic of South Africa which states that everyone has inherent dignity and the right to have their dignity respected and protected.
9. I understand that Smart Helpers Center will find me a suitable Helper based on the information I have provided. Should the chosen helper become unavailable to render the service, Smart Helper Center will replace the helper within 48 hours of being notified, in agreement with the employer.
10. I agree, that making false statements, and or complaints of Smart Helpers Center of whatsoever kind in a public forum that cannot be substantiated, might lead to the irreparable harm of Smart Helpers Center and will be investigated and Smart Helpers Center will take the necessary steps to prevent same and if there are any legal proceedings instituted against the complainant, the costs will be for the account of the complainant.
11. Smart Helpers Center’ rights remain reserved.
12. I agree to pay the agreed amount into the banking details supplied above and will under no circumstances pay the Helper on duty directly. If no payment is received within 48 hours of agreed schedule, services will be suspended until the payment is received.
13. Smart Helpers Center encourages employers that wish to hire their part-time helpers on a full-time basis. Should I wish to hire a Smart helper on a full-time basis, I agree to inform Smart Helpers Center and so to follow Smart Helpers Center Full-Time Hiring process. A penalty of R5000 will be imposed to the employer if he/she hire a SHC Helper for 1 or more days without Smart Helpers Center’s knowledge and or approval.
14. I hereby acknowledge and agree to the above terms and conditions. Furthermore, I agree to be bound to the information as provided by myself (i.e. rate per hour, working hours and job description). If there is any deviation from the information provided resulting in disputes, I acknowledge that Smart Helpers Center will not be required to replace the chosen Helper free of charge within the agreed guarantee period
I accept the “Placement Contract” on the terms and conditions set out in this document.
